Terms and Conditions of Use

Welcome to ChessEscape and other digital products developed by Saint Martin Games (“the Company”). These Terms and Conditions of Use (“Terms”) constitute a legally binding contract between you (“the User”) and the Company. They govern access, download, installation, and use of the application, its associated services, updates, and all related content. By accessing or using the Application, the User fully and irrevocably accepts these Terms. If you do not agree, you must refrain from installing, accessing, or using the Application.
1. Company Presentation and Scope
Saint Martin Games is an independent video game development studio based in Colombia. Its purpose is to design and deliver digital experiences focused on entertainment and innovation. These Terms apply to all access or use of ChessEscape and any other applications, games, digital services, websites, or content developed by the Company. The Terms apply universally, regardless of the User’s country of residence or the device used, except where mandatory legal provisions dictate otherwise.
2. Definitions
For clarity, the following definitions apply:
- “Application”: any software, game, digital service, or content offered by the Company, including ChessEscape.
- “User”: any individual who accesses, installs, or uses the Application.
- “Account”: a unique registration created by a User to access certain functionalities.
- “Digital Content”: all graphics, sounds, characters, levels, data, virtual rewards, and elements generated in the Application.
- “Platforms”: digital stores (Google Play, App Store) or third-party services (e.g., Unity, Google).
In case of conflict between these definitions and applicable legal provisions in a specific jurisdiction, these definitions shall prevail to the maximum extent permitted by law.
3. Acceptance and Minimum Age
The User declares to be of legal age in their country of residence or, if not, to have obtained the consent of their parents, guardians, or legal representatives to install and use the Application. Use by minors without such consent is strictly prohibited. The User acknowledges that the Company cannot absolutely verify the truth of this declaration and accepts that all responsibility for minors’ access rests with parents or guardians.
Installation, registration, or use of the Application constitutes express acceptance of these Terms.
4. Access and Limited License
Saint Martin Games grants the User a personal, revocable, non-exclusive, and non-transferable license to use the Application solely for personal entertainment purposes. The User does not acquire any ownership rights over the Application or its Digital Content. Any use not expressly covered by this license shall be deemed unauthorized.
It is strictly prohibited to: copy, modify, decompile, translate, reverse engineer, distribute, rent, or commercially exploit the Application without written consent from the Company. Any attempt to breach these restrictions will be considered a serious violation and may result in legal and civil penalties.
5. User Accounts and Guest Access
The User may access the Application as a guest or by creating an Account linked to third-party services (e.g., Google). Each Account is personal and non-transferable. The User is solely responsible for the security of their credentials and for all activity conducted under their Account. The Company shall not be liable for unauthorized access arising from the User’s negligence, nor for loss of data caused by poor security management.
6. Responsible Use and Mental Health
The Application is designed solely as a means of entertainment. Saint Martin Games is not responsible for excessive, compulsive, or addictive use of the Application, nor for any psychological, emotional, family, social, or work-related consequences such use may cause. The User acknowledges that managing their playtime and gaming habits is their sole responsibility.
The Company recommends:
- Playing in moderation.
- Taking regular breaks and limiting long sessions.
- Avoiding gameplay in inappropriate contexts such as during work, study, or driving.
- Seeking professional help if symptoms of addiction or emotional distress are detected.
The User expressly releases Saint Martin Games from any liability related to mental, emotional, or behavioral health arising from inappropriate use of the Application.
7. Intellectual Property and Digital Content
All elements of the Application (code, graphics, animations, characters, effects, sounds, logos, databases, and other materials) are the exclusive property of the Company or its licensors. The User does not acquire ownership rights, only a limited right of use. Reproduction, distribution, modification, sublicensing, lending, or commercialization of these elements is prohibited unless expressly authorized.
Virtual elements obtained within the Application have no economic value outside of it. The Company does not guarantee their permanence and may modify, remove, or suspend availability at any time without compensation.
8. Purchases and Transactions
The Application may include in-app purchases (e.g., ad removal, items, expansions). All transactions shall be subject to the conditions of the relevant digital store. The User acknowledges that purchases are final and non-refundable, except where mandatory law provides otherwise. Saint Martin Games is not responsible for third-party payment system failures or misuse of registered payment methods by the User.
9. Advertising, Links, and Third-Party Content
The Application may display advertisements, promotions, or external links. The Company does not control or endorse third-party content and is not responsible for its availability, accuracy, or safety. The User accesses such external services at their own risk.
10. User Conduct
The User agrees not to engage in prohibited conduct such as:
- Using cheats, bots, hacks, exploits, or unauthorized software.
- Tampering with the Application or unauthorized access to servers and data.
- Harassment, insults, defamation, racism, xenophobia, or offensive behavior toward other users or the Company.
- Using the Application for illegal purposes or contrary to morality and public order.
Breach of this section authorizes the Company to suspend or terminate the User’s Account without compensation.
11. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for technical failures, service interruptions, errors, data loss, direct or indirect damages, incidental, consequential, or punitive damages. This includes loss of income, opportunities, reputation, or any other intangible harm. The User acknowledges that they use the Application at their own risk and accepts that Saint Martin Games does not guarantee continuity, absolute security, or absence of errors.
12. Medical Risks and Epilepsy
Prolonged exposure to video games may cause physical discomfort such as eye strain, dizziness, or seizures in sensitive individuals. If symptoms occur, the User must stop using the Application and consult a doctor. Minors and individuals with medical histories must use the Application with special caution. The User releases the Company from liability for any medical effects, except where mandatory law dictates otherwise.
13. Suspension, Sanctions, and Termination
Saint Martin Games reserves the right to temporarily or permanently suspend User access for:
- Fraud, breach of Terms, or abusive use.
- Irregular acquisition of virtual elements through exploits or external programs.
- Illegal conduct or harmful actions toward the community.
Suspension does not generate a right to refund. The Company may delete Digital Content associated with violations without further liability.
14. Privacy and Data Processing
The Company collects and processes personal data in accordance with its Privacy Policy, which forms an integral part of these Terms. Data processed includes login information, gameplay progress, device identifiers, and usage statistics. The User authorizes data processing for the functioning of the Application and acknowledges that data may be shared with external providers (Unity, Google, among others). 15. Support and User Assistance
Saint Martin Games provides limited technical support through official channels. Resolution is not guaranteed immediately, nor does the Company assist with gameplay progression. The Company may refuse to respond to disrespectful, fraudulent, or abusive requests. The User acknowledges that support is provided “as available” and without guarantees of final resolution.
16. Modifications to the Application and Terms
The Company may update, modify, suspend, or withdraw the Application at any time. Likewise, these Terms may be revised. Continued use by the User after publication constitutes acceptance of changes. The current version will always be available on the Company’s official website.
17. Jurisdiction and Applicable Law
These Terms are governed by the laws of the Republic of Colombia. In case of dispute, the parties submit to the competent courts of Medellín, unless mandatory legal provisions in the User’s jurisdiction provide otherwise.
18. Final Provisions
The invalidity of any clause shall not affect the validity of the remaining clauses. The Company’s failure to exercise a right does not imply waiver of it. These Terms remain in force as long as the Application is available or until the User ceases its use. The User acknowledges that reading these Terms is a prerequisite for using the Application.
